The negative karma of ill-gotten gains (updated)

My blogger friend Donplaypuks requested that I help publicize the despicable show trial wherein the Malaysian Association of Chinese Comedians aka MACC has been trying to inflict pain and confusion on Rosli Dahlan (right) - a lawyer who got sucked into this mess simply for acting as legal counsel for former CCID chief Ramli Yusoff, who happens to be former IGP Musa Hassan's arch-enemy and rival for the post of Top Cop. Din Merican has done a great job of providing a blow-by-blow account of the grotesque proceedings, having diligently attended every session at court.

There appears to be no end to the disgusting shit flying around the political arena.


Almost 13 years later, Teoh Beng Hock's untimely death while in MACC custody remains unexplained - and nobody has been charged with culpable homicide. The inquest plodded along at snail's pace, making a complete mockery of justice. And even after a Royal Commission of Inquiry was convened as a result of public pressure, it turned out to be merely a delay tactic - because not one of the MACC interrogators has been convicted of being an accessory to murder or even for gross abuse of power.

All those mysterious deaths in police custody - not only A. Kugan's which received wide publicity but so many others (including the shocking case of a 14-year-old boy shot in the back of his head in a late-night car chase) - and not a single PDRM head has rolled, only a couple of low-ranking patsies scapegoated (as usual).

The RM13 billion PKFZ scandal is in danger of being completely covered in cobwebs, now that the man who initiated an official investigation has lost his job as MCA president. True, retired warlord Ling Liong Sik is being trotted out to take the rap, but it remains to be seen how his trial proceeds. Will he bare his soul and help bring his fellow criminal conspirators to justice? It would delight me no end to see the Three Tuns audited and behind bars (instead of hanging around in pubs). You know which three Tuns I'm referring to: Mahathir, Daim and Abdullah Badawi. [Since this was written a far bigger scandal has superseded PKFZ, namely the monstrous 1MDB scam that has left a staggering national debt of more than RM42 billion. Money-laundering investigations are underway in at least 6 countries.]

After nearly 16 years, the ghost of Altantuya still haunts Putrajaya - and MACC, as to be expected, chickened out of its commitment to meeting P.I. Balasubramaniam in London. It's clear as day the trail of serious wrongdoing leads directly to Najib Razak's desk. The macabre Altantuya Affair, intimately linked as it is with the disgraceful Scorpene and Agosta submarines scandal, ought to have terminated the present corrupt regime - because they are all implicated in the cover-up.

And, of course, the entire world is still sniggering at Famous Anus jokes and asking why Anwar Ibrahim appears to have been singled out for the dubious honor of being the only Malaysian to be charged with sodomy - TWICE in 10 years! Let's not even mention the disgraceful farce that has passed for a trial - even if his surprise acquittal on 9 January 2012 was an unexpected U-turn, indicative of conflicts within Umno's top leadership.

Meanwhile the defence ministry nonchalantly carries on with the purchase of all kinds of useless and unserviceable ordnance - all at outrageously marked up prices - while RM300,000 jet engines go missing and yet another Indian gets scapegoated.

All this rampant corruption and injustice hogging the headlines leaves me speechless. What can I say (apart from Tak Boleh lah, Bolehland)?

I have friends who still earn monthly salaries working for BN-owned media (oh sure, your kids deserve the best education money can buy, so they can get well-paying jobs after they graduate with Apco Worldwide, Halliburton, or BP).

As for Vincent Tan's deal-gone-sour with Najib, frankly I don't give a shit. I have no personal bone to pick with Vincent Tan (left), even though rumors are rife that he was instrumental in financing the defection of Hee Yit Foong and the collapse of the Pakatan Rakyat state government in Perak. Just because Vincent Tan looks like a real tough hombre who drives a hard-nosed bargain doesn't mean he deserves to have his bloodline terminated (although I wouldn't protest too vigorously if Vincent and his fellow money-grubbing moguls like Rupert Murdoch swiftly became an extinct species on this planet).

Nor do I have a personal grudge against business tycoon Kam Woon Wah, erstwhile MCA secretary-general, whose son Andrew Kam Tai Yeow (left) is the guy behind the revival of the controversial Raub Australian Gold Mining Sdn Bhd (a subsidiary of London-based Peninsular Gold Ltd).

But I met some of the Bukit Koman residents spearheading the campaign against Andrew Kam's highly polluting gold mine outside Raub and was inspired by their courage and resolve to stop the operations against all odds. For a start, the Pahang royal house has shares in the venture, which might explain why the police saw fit to arrest and detain overnight those leading the protest against the toxic gold mine. However, the Bukit Koman residents remain undaunted, though at a loss as to what to do next. Word has it that there really isn't as much gold to be found as the investors had hoped, which could put them out of business sooner than they expect. One can only wish such sociopathic miscreants a spectacular failure.

It's the same old tiresome scenario. Whether the villain of the piece happens to be Union Carbide in Bhopal, BP-Halliburton in the Gulf of Mexico, the Bakun Hydroelectric Project in Sarawak, the Three Gorges Dam in China, Peninsular Gold in Bukit Koman, Lynas Rare Earth in Gebeng, or bauxite mining near Kuantan - it's invariably a conspiracy of already rich folks trying to get even richer at the expense of ordinary citizens with no financial or political clout.

What can I do about it - apart from keeping the story in the public eye? Just as I can't persuade billions of humans to turn their backs on fizzy drinks, commercialized football, and their pathological addiction to newspapers and TV, I doubt I can wean people off their compulsion to find gold and hoard it. especially not if their surname happens to be Kam (which, in Chinese, means "gold"). Who cares if toxic chemicals seep into the groundwater and the air is polluted with rash-inducing particles?

It's painfully embarrassing that we have to suffer the grandiose extravagance of so many royal households - each with its grubby fingers in multiple business pies. Surely anyone receiving a generous allowance for simply existing would be well satisfied and refrain from soiling their hands with dubious and unsavory business ventures? Alas, this has not been the case - at least not since the Mahathir Era. Everybody wants to be another King Farouk or live in ungodly splendor like the Saudi Royals.

It doesn't matter how the money is obtained, how many are made to suffer the deleterious consequences - or what hideous ruin is inflicted on the environment.

Well, I can envisage a time when the only individuals entitled to royalty claims will be those who can produce works of beauty and enduring truth in the form of artifacts like films, music, literature, stimulating dance performances, inspiring murals, public sculptures, and magnificent buildings.

ALTANTUYA MURDER ~ THE MISSING LINKS by Americk Sidhu (reprise)

COMMENT This is the first time in 38 years I have actually found myself in agreement with (former) prime minister Dr Mahathir Mohamad and his recent, although rather belated, queries in respect of the Altantuya Shaariibuu murder saga.

These questions make sense. These are the same questions a very large portion of the Malaysian population has been asking for over eight years now.

Khalid Abu Bakar (right), our beloved (former) inspector-general of police (IGP), has in the meantime, been performing backward somersaults trying to avoid the entire issue and instead, appears to have dedicated his entire career to tracking Twitter messages on social media.

'Twitter Khalid' has even had the audacity to threaten (which he is very good at) anyone who dares to bring up the issue of 'motive' in the grisly murder of an innocent female foreign national at the hands of two of Malaysia's best trained commandos.

The excuse Khalid has given is that the Federal Court has made a decision and any questioning of the reasons behind that decision would be tantamount to contempt of court.

What Khalid has failed miserably to appreciate is the fact that no one is 'questioning' that decision. Everyone agrees the decision is correct.

However, it is the question of motive which has never been addressed in any of the three courts this murder trial has progressed through. In fact, evidence in respect of motive was never tendered by the prosecution.

Therefore, as far as I (and Mahathir) are concerned, it is still open season on motive.

So instead of terrorising twitterers, perhaps Khalid may see fit to revisit this issue with a little more fervour than he has shown in the past.

Despite the press releases being launched from the IGP's office, none of them detract from the fact that convicted murderer Sirul Azhar Umar has categorically said no officer from the Polis Di-Raja Malaysia (PDRM) has visited him in Sydney to interview him.

If Khalid disputes this, all he has to do is release the names of those officers who ostensibly attended to Sirul (left) and the exact date and time they clocked in with the detention centre authorities. Inspector Tonny Luggan (the investigating officer in Altantuya's case) says he was not sent to see Sirul in Sydney, so who was?

Khalid is also reported to have said that "Sirul's remark showed the fugitive was doing his utmost to bring disrepute and cast doubt over the investigations into the murder case, his involvement and the criminal justice system."

Yes. That is correct, because it is obvious to everyone that your investigations are incomplete.

As the current series of events appear to translate, Sirul is not disputing his involvement in the murder. All he is saying is that others were involved and they haven't been brought to book so why should he take the rap?

One need not have successfully completed an in-depth course in criminal investigation at Pulapol (Malaysian Police Training Centre) to be able to decipher the glaring holes in this entire saga.

A cursory viewing of a couple of episodes of Miami Vice or CSI New York would suffice in providing a clue as to how the matter ought to have been professionally addressed.

The established facts

Azilah Hadri and Sirul have been convicted of the murder of Altantuya by the highest court in our land. This has therefore been proved beyond a reasonable doubt.

In the circumstances, there can be no question that these two gentlemen were in fact responsible for lodging two bullets in this poor lady's head and thereafter detonating some military grade explosives placed on her body causing it to be dissipated in the vicinity of some secondary jungle on the outskirts of Kuala Lumpur.

Sirul, who has, rather astutely, sought refuge at the Villawood detention centre on the outskirts of Sydney, has candidly admitted he was acting under orders and that he has been made a scapegoat for others who had not been brought to court.

In other words, he has tacitly admitted to the crime and confirmed that there may have been others behind it.

The question is why would Sirul and Azilah (right) have done this for no apparent reason? The courts have been interested only in whether an offence of murder had been committed and not why it was committed.

The prosecution failed to seek or put forth an explanation.

This is really the question which the IGP can provide an answer to if he is so inclined. He certainly has the resources. As long as he possesses the will, he most certainly will find the way.

Khalid, for goodness sake, please, just do your job. At the moment the general public perceive inactivity on your part as yet another ubiquitous and notorious Malaysian cover-up.

May I suggest you simply haul up the following characters and ask them these simple questions:

Azilah - Why did you and Sirul kill someone you didn't even know?

DSP Musa Safri (left) (then aide de camp DPM Najib Razak) - What exactly did you tell Sirul and Azilah to do to that poor Mongolian lady and who exactly asked you to engage their services?

Nasir Safar (Najib’s special officer) - What were you doing driving around in front of Abdul Razak Baginda's house on the evening of Oct 19, 2006, watching Azilah and Sirul abduct Altantuya?

PM Najib - Did you know that four of your staff were involved in this? If so, then why were they?

Deepak Jaikishan (businessman with close ties to Najib’s wife, Rosmah Mansor - Who asked you to shut private eye P Balasubramaniam up and get him and his family out of Malaysia immediately after he released SD1 (first statutory declaration)? (This should be easy as Deepak has already confessed to all of this).

Rosmah - Was it you? If not, then who?

Johari Razak (Najib’s younger brother) - Did you telephone senior lawyer Cecil Abraham on the evening of July 3, 2008 and ask him to prepare SD2 for Balasubramaniam to sign? If so why, and on whose behalf?

Cecil - Did you receive a telephone call from Johari Razak on July 3, 2008 to prepare SD2? If so, did you?

Sunil Abraham (Cecil’s son, who is also a lawyer) - Did you or did you not, assist your father in preparing SD2 and did you then personally deliver it to the Hilton Hotel, KL Sentral on the morning of July 4, 2008?

Zainal Abidin Muhayat - Were you a commissioner for oaths in 2008 and did you have your office at Zul Rafique and Partners, Lorong P Ramlee, Kuala Lumpur? If so, who sent you to the Hilton Hotel, KL Sentral on July 4, 2008 to attest the signature of one Balasubramaniam on SD2?

Nazim Razak (another brother of Najib) - Were you and your wife at the Curve, Mutiara Damansara late in the night of July 3, 2008? If so did you meet one Balasubramaniam (right) next to the VW showroom?

And if so, did you or did you not, threaten Balasubramaniam to follow the instructions of one Deepak Jaikishan and leave the country with his family immediately, otherwise his family's safety could not be guaranteed?

Najib - Did you instruct Johari and Nazim to arrange, respectively, for SD2 to be prepared and Balasubramaniam's subsequent departure from Malaysia? If so, why was that necessary?

Hamzah Zainuddin (Umno MP for Larut) - Did you, in 2011, offer Balasubramaniam safe passage back to this country and a cash inducement if he pleaded guilty to affirming a false statutory declaration (SD1). If so, why and on behalf of whom?

Khalid, may I also suggest that you contact a senior investigation officer from the Malaysian Anti-Corruption Commission (MACC) by the name of Abdul Rahman Bachok. He is a very diligent officer and has the entire file on investigations into the circumstances under which Balasubramaniam affirmed SD2. I am sure he will lend you his file and assist you in any way he can.

I believe he is a little annoyed that his file has been closed by the Attorney-General's Chambers. He had put a lot of effort into his investigations.

You may also care to contact the Brickfields police station and ask them why they have not followed up on the police report I lodged on July 8, 2008 in respect of Balasubramaniam's disappearance. I have sent them reminders but there has been no response.

All the above 'persons of interest' and their answers to the questions posed may possibly assist in revealing a motive for the crime. Is there any reason why you, Mr IGP would be disinclined to pursue the matter further and if so what are those reasons?

BALA'S AFFIDAVIT TO THE MACC

AFFIDAVIT

I, Balasubramaniam a/l Perumal, (NRIC NO: 600928-08-6235) a Malaysian citizen of full age and of No. 32, Jalan Pelangi 1, Taman Pelangi, Rawang, 48000, Selangor, Malaysia, do solemnly and sincerely affirm and state as follows:

1. I am a private investigator by profession. I was born in Malaysia on the 28.09.1960 and am married to A. Santamil Selvi Alau Malay. I have 3 children, Kishen, born on the 07.02.1997, Menaga, born on the 22.08.1998 and Reeshi, born on the 04.02.2002. I can be contacted through my lawyer Mr. Americk Sidhu.

2. On the 05.07.2010, my lawyer received couriered documents from the Malaysian Anti Corruption Commission (MACC), which were sent to his hotel in London, setting out a series of questions they wished me to answer in relation to their investigations into an offence connected to report No: IPA 0350/2009.

3. These questions are now answered in the order they have been set out in the request from the MACC dated the 1st July 2010 which is annexed hereto marked as Exhibit ‘PIB-1’.

Question 2 : 1st Statutory Declaration (SD) dated 1st July 2008

2.1 Answer

The 1st SD is about the relationships between Abdul Razak Baginda, Najib Tun Razak and Altantuya Sharibuu and the circumstances in which I found myself involved in a series of events prior to the murder of Altantuya.

The circumstances which led me to make this 1st SD can be summarized by saying that I felt it was my moral duty as a law abiding citizen, to bring to the attention of the authorities the cover ups I felt were being orchestrated by the police investigation team in cohorts [sic] with the Attorney Generals Chambers in this case which appeared to me to have been designed to protect the real perpetrators and organizers behind this murder.


I was present at the front gates of Razak Baginda’s residence in Damansara Heights, Kuala Lumpur in the evening of the 19.10.2006 when Chief Inspector Azilah Hadri, Corporal Sirul Azahar and Lance Corporal Rohaniza drove up in a red Proton Aeroback and took Altantuya away. I believe these 2 gentlemen were the bodyguards of Najib Razak.

I also noticed around the same time that another blue proton car, driven by a Malay man, passed by very slowly. This driver appeared to be studying the scene outside Razak Baginda’s house very carefully.

I have since identified this Malay man as one Nasir Safar (left), another close confidant of Najib Razak and his personal assistant.

I was again on duty outside Razak Baginda’s house in the evening of the 22.10.2006 when 3 of Altantuya’s girlfriends and their private investigator, Mr. Ang, turned up looking for her. They were causing a commotion so I called the police. An Inspector from the Dang Wangi police station turned up in a patrol car.

It was at this stage I received a call on my handphone from one Musa Safri, whom I believe was the ADC to Najib Razak. Musa Safri asked me to pass my handphone to the Inspector from the Dang Wangi police station who persuaded these girls to disperse.

It was Razak Baginda who had given Musa Safri my handphone number.

I had informed the police of these circumstances when they were recording s.112 statements from me during their investigations into this murder.

In total, I have given the police 5 statements in relation to their investigations, the details of which are as follows:

I. Statement recorded by DSP Gan Tack Guan of the D9 Serious Crimes department from the 01.11.2006 extending for about 3 months with questioning taking place on average twice a week. No deletion of references to Najib Tun Razak.

II. Statement recorded by a Malay lady ASP at the D7 Vice department on one occasion in November 2006. No deletion of references to Najib Tun Razak.

III. Statement recorded by the D6 intelligence division at police headquarters, Bukit Aman beginning the day after Razak Baginda was charged in court, continuously for 7 days while I was under remand. This is the statement in which all references to Najib Tun Razak were removed before I signed it.

IV. Statement recorded by the Child Protection Unit at Jalan Duta the day after I was released from remand at Bukit Aman. There was no deletion of Najib Tun Razak’s name from this statement because it was audio recorded.

V. Statement recorded at D9 division by DSP Gan Tack Guan in January or February 2007. This statement is the one in which DPP Salehuddin was doing the questioning over the phone and DSP Gan recorded my answers. This was just before the trial began.

I was never asked any question relating to the involvement of Najib Tun Razak in this matter when I was summoned to give evidence for the prosecution in court.

I was therefore concerned that the police and the prosecution were trying to protect and cover up the involvement of persons very closely connected to Najib Tun Razak. I believe the police recorded a statement from Musa Safri but this gentleman was never called as a witness in court and neither was Najib Tun Razak.


I felt it was necessary for the public to know exactly who the personalities involved in this murder were and that further investigations should have been pursued to discover the motive behind the killing of an innocent foreign national.

This is why I made that 1st SD.

2.2 Answer

I first made this SD at my lawyers office in Kuala Lumpur. I began narrating my experience to my lawyer sometime in early May 2008 over a period of about 2 months before it was completed.

2.3 Answer

The reason why I made this SD has been summarized in the answer given to question 2.1 above. My lawyer drafted this 1st SD based on my statements, information and knowledge of the events set out therein and narrated to him.

2.4 Answer

No one ‘instructed’ me to make this SD. I made it of my own free will without influence from any other party. The only other person involved in preparing the 1st SD was my lawyer Mr. Americk Sidhu. He was able to decipher my narration of the relevant events and to produce a legally coherent document on my behalf. My lawyer had no interests in assisting me. I had previously tried to find a lawyer to assist me but none seem prepared to do so.

2.5 Answer

My lawyer drafted this 1st SD.

Yes, all the matters stated in my 1st SD were within my personal knowledge.

I have been advised by my lawyers and verily believe that legally and technically speaking everything I have sworn to in my 1st SD that had been told to me by Abdul Razak Baginda and Altantuya as coming from some other person could be classified as hearsay as to the truth of such 3rd party statement but not as to the fact that either Abdul Razak Baginda or Altantuya repeated it to me.

The rest of the contents of my 1st SD is not hearsay.

2.6 Answer

As far as I am concerned there is nothing in my 1st SD which could be categorized as an untruth.

2.7 Answer

I was employed by Abdul Razak Baginda in my capacity as a Private Investigator. Our relationship would therefore be one of an employer/employee.

Yes, I had met Abdul Razak Baginda before I signed my 1st SD. I had met him on a number of occasions during the course of my employment but I cannot remember the exact number of times we came face to face.

When I first met Razak Baginda at his office at Wisma Getah Asli, he explained to me what had been happening as far as the harassment he was receiving from Altantuya was concerned and the purpose of my employment.

I had enquired from him as to why he had not reported the matter to the police. He told me he could not have the police involved as this may have jeopardize the position of a VIP who was also involved in his problem with Altantuya. Razak Baginda never mentioned who this VIP was at that stage.

I only discovered that the VIP he had been referring to throughout my employment with him was Najib Tun Razak. This was at the office of Razak Baginda’s lawyer on the morning of his arrest.

This occurred when Razak Baginda received an sms on his handphone while seated with me in front of his lawyer. He showed us both this message which read …” I am seeing the IGP at 11.00 am today….matter will be solved….be cool”.

Razak Baginda then admitted the VIP he had been referring to all along was Najib and the sms he had just received was from him.

2.8 Answer

I met Abdul Razak Baginda because he wanted a Private Investigator to keep Altantuya from harassing him and his family. Razak Baginda’s lawyer by the name of Dhirren Norendra advised Razak Baginda to contact me. I think Dhirren had seen my advert in the Bar Council magazine.

2.9 Answer

I met Razak Baginda at his office at the Bangunan Getah Asli, Jalan Ampang, Kuala Lumpur.

2.10 and 2.11 Answers

Please refer to paragraphs 3 to 24 of my 1st SD. The required explanations are succinctly set out in these paragraphs. A copy of my 1st SD is annexed hereto marked as Exhibit ‘PIB-2’.

2.12 Answer

I was not forced to sign the 1st SD. I was also not under any form of duress when I did so. I signed this SD completely voluntarily. My lawyer had prepared it on my instructions.

2.13 Answer

I was not offered any money by any party to affirm my 1st SD.

The subsequent questions nos. 2.14 to 2.16 are therefore irrelevant.

Question 3 : 2nd Statutory Declaration (SD) dated 4th July 2008

The answers to questions 3.1 to 3.19 are set out in the Q&A’s Parts 1, 2 & 3, prepared by my lawyers in October 2009 and which are annexed hereto as Exhibits’ PIB-3’, ‘PIB-4’ and ‘PIB-5’. Detailed explanations are provided in respect of all the questions posed under this head.

Question 4 : Other relevant matters

4.1 Answer

I have received more than 4 cheques from Deepak Jaikishan amounting to more than RM200,000.00. In fact Deepak has paid me a total of approximately RM750,000.00 over the space of about 1 year, from July 2008 to July 2009.

4.2 Answer

The reason why Deepak gave me these cheques is explained in detail in exhibits ‘PIB-3’, ‘PIB-4’ and ‘PIB-5’.

4.3, 4.4, 4.5, 4.6, 4.7 Answers

Deepak handed over the cheques to ASP Suresh who in turn handed them to a friend of mine. These cheques were then paid into my friend’s bank account in KL and the funds forwarded by telegraphic transfer to India. This was possible because Deepak left the payee blank. Alternatively, if the cheques were for cash, the funds were also forwarded to me in India by my friends after they were cashed.

Deepak also made payments into my wife’s bank account with the EON Bank in Kuala Lumpur from time to time.

Copies of my wife’s bank statements with the EON Bank showing substantial deposits and a dishonoured cheque from a company called ‘Mekar Dayabumi Sdn Bhd’ are annexed hereto collectively marked as Exhibit ‘PIB-6’.

I did not need to seek clarification from anyone regarding these cheques as I understood what they were for.

Annexed to this affidavit are copies of cheques I received from Deepak Jaikishan and Carpet Raya Sdn Bhd respectively:

Cheque No. 014554 dated 18.12.2008 in the sum of RM50,000.00 ( Exhibit ‘PIB-7’)

Cheque No. 014555 dated 22.12.2008 in the sum of RM50,000.00 (Exhibit ‘PIB-8’)

Cheque No. 014556 dated 26.12.2008 in the sum of RM50,000.00 (Exhibit ‘PIB-9’)

Cheque No. 014557 dated 31.12.2008 in the sum of RM50,000.00 (Exhibit ‘PIB-10’)

Cheque No. 014558 dated 18.01.2009 in the sum of RM50,000.00 (Exhibit ‘PIB-11’)

Cheque No. 564331 dated 31.03.2009 in the sum of RM50,000.00 (Exhibit ‘PIB-12’)

4.8 Answer

The reason why I decided to disclose the events and circumstances of this case is again clearly set out in detail in exhibits ‘PIB-3’, ‘PIB-4’ and ‘PIB-5’.

4. All of the answers to the questions posed above and as set out in ‘PIB-1’ are true to the best of my knowledge and belief and are provided based on my own knowledge and belief and I further hereby confirm that no party whatsoever has influenced any of my answers.
