The following is the full 16-page statutory declaration signed by Abdul Razak Baginda's private investigor P. Balasubramaniam on July 1 2008.

I, Balasubramaniam a/l Perumal ... do solemly and sincerely declare as follows:

1. I have been a police officer with the Royal Malaysian Police Force, having joined as a constable in 1981 attached to the police field force. I was then promoted to the rank of lance corporal and finally resigned from the police force in 1998 when I was with the Special Branch.

2. I have been working as a freelance private investigator since I left the police force.

3. Sometime in June or July 2006, I was employed by Abdul Razak Baginda for a period of 10 days to look after him at his office at the Bangunan Getah Asli, Jalan Ampang between the hours of 8am to 5pm each working day as apparently he was experiencing disturbances from a third party.

4. I resigned from this job after 2½ days as I was not receiving any proper instructions.

5. I was however re-employed by Abdul Razak Baginda on the Oct 5, 2006 as he had apparently received a harassing phone call from a Chinese man calling himself ASP Tan who had threatened him to pay his debts. I later found out this gentleman was in fact a private investigator called Ang who was employed by a Mongolian woman called Altantuya Shaaribuu.

6. Abdul Razak Baginda was concerned that a person by the name of Altantuya Shaaribuu, a Mongolian woman, was behind this threat and that she would be arriving in Malaysia very soon to try and contact him.

7. Abdul Razak Baginda informed me that he was concerned by this as he had been advised that Altantuya Shaaribuu had been given some powers by a Mongolian ‘bomoh’ and that he could never look her in the face because of this.

8. When I enquired as to who this Mongolian woman was, Abdul Razak Baginda informed me that she was a friend of his who had been introduced to him by a VIP and who asked him to look after her financially.

9. I advised him to lodge a police report concerning the threatening phone call he had received from the Chinese man known as ASP Tan but he refused to do so as he informed me there were some high-profile people involved.

10. Abdul Razak Baginda further told me that Altantuya Shaaribuu was a great liar and good in convincing people. She was supposed to have been very demanding financially and that he had even financed a property for her in Mongolia.

11. Abdul Razak Baginda then let me listen to some voice messages on his handphone asking him to pay what was due otherwise he would be harmed and his daughter harassed.

12. I was therefore supposed to protect his daughter Rowena as well.

13. On Oct 9, 2006 I received a phone call from Abdul Razak Baginda at about 9.30am informing me that Altantuya was in his office and he wanted me there immediately. As I was in the midst of a surveillance, I sent my assistant Suras to Abdul Razak Baginda’s office and I followed a little later. Suras managed to control the situation and had persuaded Altantuya and her two friends to leave the premises. However Altantuya left a note written on some Hotel Malaya notepaper, in English, asking Abdul Razak Baginda to call her on her handphone (number given) and wrote down her room number as well.

14. Altantuya had introduced herself to Suras as ‘Aminah’ and had informed Suras she was there to see her boyfriend Abdul Razak Baginda.

15. These three Mongolian girls however returned to Abdul Razak Baginda’s office at the Bangunan Getah Asli, Jalan Ampang again, the next day at about 12 noon. They did not enter the building but again informed Suras that they wanted to meet Aminah’s boyfriend, Abdul Razak Baginda.

16. On Oct 11, 2006, Aminah returned to Abdul Razak Baginda’s office on her own and gave me a note to pass to him, which I did. Abdul Razak Baginda showed me the note which basically asked him to call her urgently.

17. I suggested to Abdul Razak Baginda that perhaps it may be wise to arrange for Aminah to be arrested if she harassed him further, but he declined as he felt she would have to return to Mongolia as soon as her cash ran out.

18. In the meantime, I had arranged for Suras to perform surveillance on Hotel Malaya to monitor the movements of these three Mongolian girls, but they recognised him. Apparently they become friends with Suras after that and he ended up spending a few nights in their hotel room.

19. When Abdul Razak Baginda discovered Suras was becoming close to Aminah he asked me to pull him out from Hotel Malaya.

20. On Oct 14, 2006, Aminah turned up at Abdul Razak Baginda’s house in Damansara Heights when I was not there. Abdul Razak Baginda called me on my handphone to inform me of this so I rushed back to his house. As I arrived, I noticed Aminah outside the front gates shouting “Razak, bastard, come out from the house”. I tried to calm her down but couldn’t, so I called the police who arrived in two patrol cars. I explained the situation to the police, who took her away to the Brickfields police station.

21. I followed the patrol cars to Brickfields police station in a taxi. I called Abdul Razak Baginda and his lawyer Dirren to lodge a police report but they refused.

22. When I was at the Brickfields police station, Aminah’s own private investigator, one Mr Ang arrived and we had a discussion. I was told to deliver a demand to Abdul Razak Baginda for US$500,000 and three tickets to Mongolia, apparently as commission owed to Aminah from a deal in Paris.

23. As Aminah had calmed down at this stage, a policewoman at the Brickfields police station advised me to leave and settle the matter amicably.

24. I duly informed Abdul Razak Baginda of the demands Aminah had made and told him I was disappointed that no one wanted to back me up in lodging a police report. We had a long discussion about the situation when I expressed a desire to pull out of this assignment.

25. During this discussion and in an attempt to persuade me to continue my employment with him, Abdul Razak Baginda informed me that:

i) He had been introduced to Aminah by Najib Razak at a diamond exhibition in Singapore.

ii) Najib Razak informed Abdul Razak Baginda that he had a sexual relationship with Aminah and that she was susceptible to anal intercourse.

iii) Najib Razak wanted Abdul Razak Baginda to look after Aminah as he did not want her to harass him since he was now the deputy prime minister.

iv) Najib Razak, Abdul Razak Baginda and Aminah had all been together at a dinner in Paris.

v) Aminah wanted money from him as she felt she was entitled to a US$500,000 commission on a submarine deal she assisted with in Paris.

26. On Oct 19, 2006, I arrived at Abdul Razak Baginda’s house in Damansara Heights to begin my night duty. I had parked my car outside as usual. I saw a yellow Proton Perdana taxi pass by with three ladies inside, one of whom was Aminah. The taxi did a U-turn and stopped in front of the house where these ladies rolled down the window and wished me ‘Happy Deepavali’. The taxi then left.

27. About 20 minutes later the taxi returned with only Aminah in it. She got out of the taxi and walked towards me and started talking to me. I sent an SMS to Abdul Razak Baginda informing him “Aminah was here”. I received an SMS from Razak instructing me “to delay her until my man comes”.

28. Whist I was talking to Aminah, she informed me of the following:

i) That she met Abdul Razak Baginda in Singapore with Najib Razak.

ii) That she had also met Abdul Razak Baginda and Najib Razak at a dinner in Paris.

iii) That she was promised a sum of US$500,000.00 as commission for assisting in a submarine deal in Paris.

iv) That Abdul Razak Baginda had bought her a house in Mongolia but her brother had refinanced it and she needed money to redeem it.

v) That her mother was ill and she needed money to pay for her treatment.

vi) That Abdul Razak Baginda had married her in Korea as her mother is Korean whilst her father was a Mongolian/Chinese mix.

vii) That if I wouldn’t allow her to see Abdul Razak Baginda, would I be able to arrange for her to see Najib Razak.

29. After talking to Aminah for about 15 minutes, a red Proton Aeroback arrived with a woman and two men. I now know the woman to be lance corporal Rohaniza and the men, Azilah Hadri and Sirul Azahar. They were all in plainclothes. Azilah walked towards me while the other two stayed in the car.

30. Azilah asked me whether the woman was Aminah and I said “Yes”. He then walked off and made a few calls on his handphone. After 10 minutes another vehicle, a blue Proton Saga, driven by a Malay man, passed by slowly. The drivers window had been wound down and the driver was looking at us.

31. Azilah then informed me they would be taking Aminah away. I informed Aminah they were arresting her. The other two persons then got out of the red Proton and exchanged seats so that lance corporal Rohaniza and Aminah were in the back while the two men were in the front. They drove off and that is the last I ever saw of Aminah.

32. Abdul Razak Baginda was not at home when all this occurred.

33. After Oct 19, 2006, I continued to work for Abdul Razak Baginda at his house in Damansara Heights from 7pm to 8am the next morning, as he had been receiving threatening text messages from a woman called ‘Amy’ who was apparently ‘Aminah’s’ cousin in Mongolia.

34. On the night of Oct 20, 2006, both of Aminah’s girlfriends turned up at Abdul Razak Baginda’s house enquiring where Aminah was. I informed them she had been arrested the night before.

35. A couple of nights later, these two Mongolian girls, Mr Ang and another Mongolian girl called ‘Amy’ turned up at Abdul Razak Baginda’s house looking for Aminah as they appeared to be convinced she was being held in the house.

36. A commotion began so I called the police who arrived shortly thereafter in a patrol car. Another patrol car arrived a short while later in which was the investigating officer from the Dang Wangi police station who was in charge of the missing persons report lodged by one of the Mongolians girls, I believe was Amy.

37. I called Abdul Razak Baginda who was at home to inform him of the events taking place at his front gate. He then called DSP Musa Safri and called me back informing me that Musa Safri would be calling my handphone and that I was to pass the phone to the inspector from Dang Wangi police station.

38. I then received a call on my handphone from Musa Safri and duly handed the phone to the Dang Wangi inspector. The conversation lasted 3-4 minutes after which he told the girls to disperse and to go to see him the next day.

39. On or about Oct 24, 2006, Abdul Razak Baginda instructed me to accompany him to the Brickfields police station as he had been advised to lodge a police report about the harassment he was receiving from these Mongolian girls.

40. Before this, Amy had sent me an SMS informing me she was going to Thailand to lodge a report with the Mongolian consulate there regarding Aminah’s disappearance. Apparently she had sent the same SMS to Abdul Razak Baginda. This is why he told me he had been advised to lodge a police report.

41. Abdul Razak Baginda informed me that DPS Musa Safri had introduced him to one DSP Idris, the head of the criminal division, Brickfields police station, and that Idris had referred him to ASP Tonny.

42. When Abdul Razak Baginda had lodged his police report at Brickfields police station, in front of ASP Tonny, he was asked to make a statement but he refused as he said he was leaving for overseas. He did however promise to prepare a statement and hand ASP Tonny a thumbdrive. I know that this was not done as ASP Tonny told me.

43. However ASP Tonny asked me the next day to provide my statement instead and so I did.

44. I stopped working for Abdul Razak Baginda on Oct 26, 2006 as this was the day he left for Hong Kong on his own.

45. In mid-November 2006, I received a phone call from ASP Tonny from the IPK Jalan Hang Tuah asking me to see him regarding Aminah’s case. When I arrived there I was immediately arrested under Section 506 of the Penal Code for criminal intimidation.

46. I was then placed in the lock up and remanded for five days. On the third day, I was released on police bail.

47. At the end of November 2006, the D9 department of the IPK sent a detective to my house to escort me to the IPK Jalan Hang Tuah. When I arrived, I was told I was being arrested under Section 302 of the Penal Code for murder. I was put in the lock up and remanded for seven days.

48. I was transported to Bukit Aman where I was interrogated and questioned about an SMS I had received from Abdul Razak Baginda on Oct 19, 2006 which read “delay her until my man arrives”. They had apparently retrieved this message from Abdul Razak Baginda’s handphone.

49. They then proceeded to record my statement from 8.30 am to 6pm everyday for seven consecutive days. I told them all I knew including everything Abdul Razak Baginda and Aminah had told me about their relationships with Najib Razak but when I came to sign my statement, these details had been left out.

50. I have given evidence in the trial of Azilah, Sirul and Abdul Razak Baginda at the Shah Alam High Court. The prosecutor did not ask me any questions in respect of Aminah’s relationship with Najib Razak or of the phone call I received from DSP Musa Safri, whom I believe was the ADC for Najib Razak and/or his wife.

51. On the day Abdul Razak Baginda was arrested, I was with him at his lawyers office at 6.30am. Abdul Razak Baginda informed us that he had sent Najib Razak an SMS the evening before as he refused to believe he was to be arrested, but had not received a response.

52. Shortly thereafter, at about 7.30am, Abdul Razak Baginda received an SMS from Najib Razak and showed, this message to both myself and his lawyer. This message read as follows: “I am seeing IGP at 11am today … matter will be solved … be cool”.

53. I have been made to understand that Abdul Razak Baginda was arrested the same morning at his office in the Bangunan Getah Asli, Jalan Ampang.

54. The purpose of this Statutory declaration is to:

i) State my disappointment at the standard of investigations conducted by the authorities into the circumstances surrounding the murder of Altantuya Shaaribuu.

ii) Bring to the notice of the relevant authorities the strong possibility that there are individuals other than the three accused who must have played a role in the murder of Altantuya Shaaribuu.

iii) Persuade the relevant authorities to reopen their investigations into this case immediately so that any fresh evidence may be presented to the court prior to submissions at the end of the prosecutions case.

iv) Emphasise the fact that having been a member of the Royal Malaysian Police Force for 17 years, I am absolutely certain no police officer would shoot someone in the head and blow up their body without receiving specific instructions from their superiors first.

v) Express my concern that should the defence not be called in the said murder trial, the accused, Azilah and Sirul will not have to swear on oath and testify as to the instructions they received and from whom they were given.

55. And I make this solemn declaration conscientiously believing the same be true and by virtue of the provisions of the Statutory Declaration Act 1960.

How naive can you be! Talk to Dr Chandra Muzaffar, Ezam and Nalla. Then you'll get a better understanding of what kind of person Anwar is. It is sad that most Malaysians are so easily deceived.

Nameless one, I measure a hero by his deeds and by his willingness to risk his neck for something he strongly believes in. Chandra Muzaffar qualified as a hero in the days when he got himself into trouble with USM and founded Aliran. Indeed, he was greatly admired and loved... until after his arrest and brief incarceration under Ops Lallang, when he suffered a subtle but insidious personality change.

I suspect Room 101 broke his fighting spirit and he went the way of Winston Smith in Orwell's 1984. Chandra was encouraged to establish his JUST Foundation and concentrate on global human rights issues. His criticisms of Mahathir became toned down and he reverted to being the brilliant academic he always had been. Well and good... but when Chandra allowed Umno to use his good name and intellectual credentials as a weapon against Anwar just before GE12, he fell from grace in my books.

Yes, I am unabashedly partisan in that I can never pretend to "objectivity." I trust my instincts and my nose... and Umno/BN stinks to high heaven! Anyone who values his soul integrity had better quit BN now before they go down with the Titanic. Even Dr M has quit Umno - but for all the wrong reasons.

As for Ezam and Nalla... they don't interest me one bit because they have no fresh political vision and are quite irrelevant to our nation's destiny. They did play their supporting roles ten years ago in 'Sodomee (Pt. One)' but, take away Anwar and these men are mere shadows.

34. On the night of Oct 20, 2006, both of Aminah’s girlfriends turned up at Abdul Razak Baginda’s house enquiring where Aminah was. I informed them she had been arrested the night before.

35. A couple of nights later, these two Mongolian girls, Mr Ang and another Mongolian girl called ‘Amy’ turned up at Abdul Razak Baginda’s house looking for Aminah as they appeared to be convinced she was being held in the house.

36. A commotion began so I called the police who arrived shortly thereafter in a patrol car. Another patrol car arrived a short while later in which was the investigating officer from the Dang Wangi police station who was in charge of the missing persons report lodged by one of the Mongolians girls, I believe was Amy.

37. I called Abdul Razak Baginda who was at home to inform him of the events taking place at his front gate. He then called DSP Musa Safri and called me back informing me that Musa Safri would be calling my handphone and that I was to pass the phone to the inspector from Dang Wangi police station.

38. I then received a call on my handphone from Musa Safri and duly handed the phone to the Dang Wangi inspector. The conversation lasted 3-4 minutes after which he told the girls to disperse and to go to see him the next day.

39. On or about Oct 24, 2006, Abdul Razak Baginda instructed me to accompany him to the Brickfields police station as he had been advised to lodge a police report about the harassment he was receiving from these Mongolian girls.

40. Before this, Amy had sent me an SMS informing me she was going to Thailand to lodge a report with the Mongolian consulate there regarding Aminah’s disappearance. Apparently she had sent the same SMS to Abdul Razak Baginda. This is why he told me he had been advised to lodge a police report.

41. Abdul Razak Baginda informed me that DPS Musa Safri had introduced him to one DSP Idris, the head of the criminal division, Brickfields police station, and that Idris had referred him to ASP Tonny.

42. When Abdul Razak Baginda had lodged his police report at Brickfields police station, in front of ASP Tonny, he was asked to make a statement but he refused as he said he was leaving for overseas. He did however promise to prepare a statement and hand ASP Tonny a thumbdrive. I know that this was not done as ASP Tonny told me.

43. However ASP Tonny asked me the next day to provide my statement instead and so I did.

44. I stopped working for Abdul Razak Baginda on Oct 26, 2006 as this was the day he left for Hong Kong on his own.

45. In mid-November 2006, I received a phone call from ASP Tonny from the IPK Jalan Hang Tuah asking me to see him regarding Aminah’s case. When I arrived there I was immediately arrested under Section 506 of the Penal Code for criminal intimidation.

46. I was then placed in the lock up and remanded for five days. On the third day, I was released on police bail.

47. At the end of November 2006, the D9 department of the IPK sent a detective to my house to escort me to the IPK Jalan Hang Tuah. When I arrived, I was told I was being arrested under Section 302 of the Penal Code for murder. I was put in the lock up and remanded for seven days.

48. I was transported to Bukit Aman where I was interrogated and questioned about an SMS I had received from Abdul Razak Baginda on Oct 19, 2006 which read “delay her until my man arrives”. They had apparently retrieved this message from Abdul Razak Baginda’s handphone.

49. They then proceeded to record my statement from 8.30 am to 6pm everyday for seven consecutive days. I told them all I knew including everything Abdul Razak Baginda and Aminah had told me about their relationships with Najib Razak but when I came to sign my statement, these details had been left out.

50. I have given evidence in the trial of Azilah, Sirul and Abdul Razak Baginda at the Shah Alam High Court. The prosecutor did not ask me any questions in respect of Aminah’s relationship with Najib Razak or of the phone call I received from DSP Musa Safri, whom I believe was the ADC for Najib Razak and/or his wife.

51. On the day Abdul Razak Baginda was arrested, I was with him at his lawyers office at 6.30am. Abdul Razak Baginda informed us that he had sent Najib Razak an SMS the evening before as he refused to believe he was to be arrested, but had not received a response.

52. Shortly thereafter, at about 7.30am, Abdul Razak Baginda received an SMS from Najib Razak and showed, this message to both myself and his lawyer. This message read as follows: “I am seeing IGP at 11am today … matter will be solved … be cool”.

53. I have been made to understand that Abdul Razak Baginda was arrested the same morning at his office in the Bangunan Getah Asli, Jalan Ampang.

54. The purpose of this Statutory declaration is to:

i) State my disappointment at the standard of investigations conducted by the authorities into the circumstances surrounding the murder of Altantuya Shaaribuu.

ii) Bring to the notice of the relevant authorities the strong possibility that there are individuals other than the three accused who must have played a role in the murder of Altantuya Shaaribuu.

iii) Persuade the relevant authorities to reopen their investigations into this case immediately so that any fresh evidence may be presented to the court prior to submissions at the end of the prosecutions case.

iv) Emphasise the fact that having been a member of the Royal Malaysian Police Force for 17 years, I am absolutely certain no police officer would shoot someone in the head and blow up their body without receiving specific instructions from their superiors first.

v) Express my concern that should the defence not be called in the said murder trial, the accused, Azilah and Sirul will not have to swear on oath and testify as to the instructions they received and from whom they were given.

55. And I make this solemn declaration conscientiously believing the same be true and by virtue of the provisions of the Statutory Declaration Act 1960.

Musa Hassan stays on as IGP (!!!???!!!)

KUALA LUMPUR, Sept 3 — The Home Ministry has renewed Tan Sri Musa Hassan’s contract as the Inspector-General of Police for one more year until September 2010, despite the opposition’s claims that he is biased and has not brought down the national crime index.

The 38-year veteran police officer currently has a two-year contract that expires September 13. The Police Force Commission had recommended the one year extension for the 57-year-old law graduate in July, The Malaysian Insider reported on July 13.

He came to national prominence 11 years ago when investigating sacked deputy prime minister Datuk Seri Anwar Ibrahim’s corruption and sodomy cases. Anwar, who is now opposition leader, has accused him of fabricating evidence.

Anwar’s Pakatan Rakyat has also blamed Musa for not fighting crime but instead pandering to the ruling Barisan Nasional government by harassing and detaining activists, opposition leaders and supporters.

Prime Minister Datuk Seri Najib Razak last week ordered Musa to take action against a group of protesters who dragged along a severed cow-head in a dispute over a relocated Hindu temple in Shah Alam.

Witnesses said the riot police on duty did not take action while opposition politicians complained of double-standards by the police, citing the heavy action against activists wearing black, holding candle-light vigils and Pakatan assemblymen trying to have state assembly meetings in Ipoh.

Musa joined the police service as an inspector on Nov 11, 1969. Since then, he has held several important posts including as Malacca prosecuting officer in 1973, Bukit Aman Narcotics Division director in 1981 and Kuala Kubu Baru Police College lecturer in 1986.

He held the post of Bukit Aman prosecution/criminal law deputy assistant director in 1995 and was Johor chief police officer in 2003. In 2004, he was appointed Criminal Investigation Department director before being made Deputy Inspector-General of Police a year later.

Musa succeeded Tan Sri Mohamed Bakri Omar as the Inspector-General in September 2006 despite allegations of corruption.

In July 2007, Attorney-General Tan Sri Abdul Gani Patail ordered the then Anti-Corruption Agency (ACA) to close their investigations that linked Musa to the release of three members of illegal betting syndicates.

He was then given a two-year extension in September 2007 when he reached retirement age.

Veteran Umno leader Tengku Razaleigh Hamzah had also weighed in on the proposed extension a month ago, criticising the routine extension of service for top civil servants which he said creates cults of personality and promotes a cosy relationship between senior officers and their political masters.

Today, I tagged along with our Human Rights Activists who have been fighting Police Abuses for a long time – S. Jayathas, S. Surendran, Manickavasagam (MP for Kapar) and M. Manohar (MP for Teluk Intan), to find out what actually transpired when the 6 were killed by the Police in Kulim.

Ever since their killing the other day, I have been very bothered by the event. The media shouted out "criminals" – as if that was the foregone truth. The Police had executed all 6 of them as if they were the Prosecutor, Judge and Executioner all in one and utterly above the law. It was not one, not two; it was six -and it seems with impunity. Every one had their own view of the episode. But I needed some answers.

At the outset, let me say that I am not condoning crimes or criminals; but there are so many questions that this incident raises that we need some good answers, and fast, as this situation seems to be spinning out of control – before the ink dries on one, another seems to happen. Kugan's case before Prabakaran's settled, and now the six before Kugan's case is settled.

We visited the shootout site, the families of 3 of the deceaseds and spent some time with the neighbour at the shootout site. The picture that emerges is different than what the mainstream media has been putting out. The MSM paints a picture that the Police only returned fire after being shot at and that this turn of events was totally unavoidable and that they were dealing with a bunch of unscrupulous criminals.


Let me detail some of the facts we gathered before commenting on them. The scene of the shooting was in a small town of Karangan some 15km from Kulim. It was in a small house which was being renovated in one of the backroads of Karangan, a little off the main road of the town. The fence around the house was a tall wall made up of corrugated sheet – something you would do to cut off from view what was going on inside.

A very forthcoming neighbour told us that when he returned home from work that rainy night at around 10 or so, he was met with a large group of policemen in front of his house, who had already packed his family into the prayer room of his house in the event of stray bullets during the impending ambush. He was asked to get in with them. He only heard the frightening shootout that dreadful night from within his prayer room.

The shootout took place at around 10.30, a very noisy and frightening episode, narrated that neighbour. There did not seem to be any attempt by the Police to try to get the people they were seeking out from the premises, by summoning them out first using hailers or some such device, before the shoot out. The shooting just happened. The neighbour knew nothing more till the bodies of the killed men were removed at somewhere between 4 and 5 am the next morning.

The first of the killed men, the one that the Police probably had a reason to get, the owner of the house where the shootout happened, was shot in the middle of the top of his head, top down it appeared. The family of this victim mentioned he had several more shots on the front side of his body – as if someone shot at him from the front. This individual, we were told by the family had no prior police record.


The second victim that we visited was someone who was actually working in Singapore for a company called SBS (maybe the Singapore Bus Company) who had come back to Kulim for a holiday. He was due to go back shortly and had a return ticket for that. His death certificate also indicated death due to shots in the chest. Apparently he had several shot wounds on the front side of his body also, as if shot from the front. He appeared to be a friend of the first victim.

It is not clear from the little information we got that this person was at all a close accomplice or even a participant in any crime that may have been in the works. Of course, I am concluding this with very little information, but these are the facts as we got them from the family. The family was distraught, because this had damaged the standing of the family in the community, having their dead son branded a criminal. This victim also has no past criminal record, we were told by the family.


The third family we visited was that of a young chap of about 20. His family lives in a dilapidated little estate house in Padang Serai. He had seven siblings and it was obvious the family was just existing. This young chap, it appears, was working for the first victim assisting in the renovation of the house where the shootout happened. The parents did not seem to know much more about what he did. He was obviously not being paid very much, as he had just 2 days before the incident asked one of his family members for 20 ringgit.

He had shot wounds on the forehead and it looked like the back of his head was all bloodied as if from an exiting bullet. He was dressed only in a towel at the time of his death. His parents even had difficulty putting together some money to buy him a shirt and a dhoty for his burial. 36 ringgit was all they had. They could not even afford the coffin in which he was ultimately buried. The Police disallowed the victims' kin to examine the body when they tried to. The body was all bloodied in the front. This victim also had no past record, we were told.


To say the least, this was a carnage. It appears like we are in Gaza or in Iraq or in Afghanistan or even in Sri Lanka – the scale and method of killing suggests nothing short of this. Let me ask, are we in one of these countries or is Malaysia descending there?

It looks like Indian lives have become very cheap, very cheap in this country – the lives of anjing keling, yes that's what it is, the cheap lives of the anjings - that they can be wasted in this manner. Uthayakumar was so right!

By all of this, I am in no way saying crime is alright. What I am saying is the way the problems of crime are being dealt with. Let me lay out some perspectives for you all to consider:

1) What was the need to kill these people? They were not terrorists. They had no previous records. They were not murderers, surely not the mafia. They could have been easily arrested. In fact, where the first victim regularly stays is just a stone's throw from the Police Station. Why were they not apprehended? Or why were they not given a chance to come out with their hands up to surrender themselves for arrest – even in war this is done. Why were they not given this chance?

2) We understand there were a number of sharp shooters from around the country on hand for the job for the Police. This seem to indicate that this was a planned kill event.

3) Why was it that the shot wounds were all in the front side of the victims – not any location on the body, but systematically on the front side?

4) One victim was shot on the top of the head. How could that happen in a normal exchange of fire? That seems to suggest some crouching position and a shot into the head, from the top.

5) Why were the victims not shot at on their legs or where they will not be killed but disabled on being shot?

6) Why were the kin of one of the victims denied their right to inspect the body?

7) If it was a shootout between the Police and the victims, only two could have had the guns, as the police produced two guns; why were the shot wounds so systematic in the chest and the heads on all three of the victims? We do not know about the other two victims – but I suspect they will show similarities.

In summary, this ugly incident in the series of incidents of police killing and atrocities seem to emphasise the following issues:

a) The Police in Malaysia continue killing Indian crime suspects with impunity – taking upon themselves the role of Prosecutor, Judge and Executioner all in one. I am sure that the powers be know exactly what they are doing. So, we have to take it that they are trying to provoke a response from us so they can slam emergency rule or something like that and set us all back?

b) The Police very urgently need to be Policed. That looks like a very remote possibility, as long as UMNO rules this country of ours. See what's happening to the reform-driven MACC, it has become just another tool of UMNO. Any IPCMC will probably end up in that same rubbish bin. In any case, this UMNO regime seems to be promoting Police brutality as a means of maintaining their hold on the levers of power.

c) So many crime suspects in Malaysia are from among the Indian community. I think the answer to this has been already abundantly answered by Uthayakumar – this underclass of Indians are a direct result of the UMNO policies over the last 50 years of marginalizing Indians – neglecting the development of the Indian community. There does not yet seem to be any serious effort to get to the bottom of this problem.

d) The way the Police are shooting Indian crime suspects seem to give additional credence to the racist line of UMNO – the anjing keling line. They seem to be wittingly or unwittingly creating a stereotype of the Indians in the country – despicable, troublecausing and uncouth Indian. What do you think the jibes of children in school reflect – when little Indian children are called "anjing keling" by their Malay classmates.

e) Poverty seems to be intertwined with all of this. Take the case of the third victim that we visited - what kind of money was he making for him to be lumped up and shot. Does this make sense, 20 years old, barely making a living and then shot in the middle. These are the youth of the country who should be nurtured and built up into the the human potential we so much need.

This is all very infuriating.

There comes a time when all of this has to stop. This cannot continue. UMNO , stop playing games and get on with doing something positive about the problem. If you do not know how, then get expert help. I am sure there are agencies around the world that can help. Or are we to take it that you just do not want to, and then the only way we can find some resolution to the problem is by replacing you, UMNO.

Selangor police chief Khalid Abu Bakar said the young man died of "an asthma attack." It must have been an extremely violent one.

Four family members of Kugan filed the police report today and they were joined by lawyers, human rights activists and several politicians from both Barisan Nasional and Pakatan Rakyat.

Among them were PKR's Kapar MP S Manikavasagam, DAP's Puchong MP Gobind Singh and Teluk Intan's DAP MP M Manoharan.

Also present was a group of MIC Youth members led by its head T Mohan. Hindraf representative, led by S Jayathas, were also there.

Some 80 people had also gathered at the police station to show their anger over Kugan's death.

They held up banners with pictures of the deceased, showing the injuries he sustained while in police custody.

Some of the banners read: "Police are licensed killers", "Police are killing Indians" and "Police are thirsty for Indian blood" in both Malay and English. They also briefly chanted slogans demanding a probe into Kugan's death.

Heavy police presence

Talking to reporters later, Kugan's family members said that the deceased did not suffer from asthma and could not have died from breathing difficulties as claimed by the police.

Manikavasagam and Gobind added that the police were attempting to cover up the death and that there should be a full and open investigation by the Home Ministry, which oversees the police department.

Manikavasagam also said that he would organise rallies to protest against the police.

The crowd then dispersed peacefully after gathering for about 30 minutes.

There was a heavy police presence outside of the station while the police report was being lodged.

Eight Federal Reserve Unit (FRU) vehicles were parked within sight of the police station.

Yesterday Khalid told reporters that Kugan had asked for a glass of water during interrogation and upon drinking the water, he collapsed and lost consciousness.

"A doctor from a clinic nearby who was summoned to examine the man, and later confirmed that he had died," he had said.

The state police chief also said that a thorough probe would be conducted on the matter and asked people not to speculate on the cause of death.

My apologies to the canine kingdom

Those of you who have been reading recent posts on this blog will know I've been poking fun at Malaysian home minister Syed Hamid Albar by comparing him to a bullmastiff. And when MP Teresa Kok complained about being served "dog food" during her week in ISA detention, I extended the canine metaphor to the entire police force - who appear to be so limited in intelligence they can't distinguish between a political party and the government of the day.

And so they end up carrying out the criminal orders of their corrupt political masters in Umno, even when these orders are detrimental to the interests of the nation and utterly ruinous to the professional reputation of the police force itself.

Case in point: two members of the Unit Tindakan Khas (Special Action Unit) have been on trial for over a year, accused of murdering the 28-year-old Mongolian paramour of both Abdul Razak Baginda and Najib Abdul Razak. Despite the latter's vehement denials that he ever met "the Mongolian woman" (he has never dared to utter her name in public, not even when swearing in a mosque during the Permatang Pauh by-election campaign), the facts indicate otherwise.

After all, Altantuya Shaariibuu was in Paris with Razak Baginda during negotiations on the French submarine deal which earned his company, Perimekar Sdn Bhd, a staggering RM534.8 million commission. It has been established beyond doubt that Najib Razak, in his capacity as defence minister, was also present in France at the time and was personally involved in the 1.4 billion euro deal. To deny that he knew Altantuya stretches the boundaries of credibility.

Especially when Najib has been caught out on more than one occasion telling a bare-faced lie: for instance, when he initially denied knowing Anwar's accuser, Saiful Bukhari Azlan, and subsequently admitted to having invited Saiful to his residence several days before the police report alleging sodomy was lodged.

Now there is absolutely no way any member of the police force will undertake to murder a foreign national in cold blood - unless acting on specific instructions from their superiors. In this instance, the commanding officer could only be DSP Musa Safri, ADC in charge of security to DPM Najib Razak. In his affidavit (which has yet to be admitted in court as evidence), Razak Baginda states that Musa Safri was assigned to assist him in resolving the Altantuya "nuisance." Musa then introduced Razak Baginda to Inspector Azilah Hadri and Korporal Sirul Azhar Umar, which led to the UTK officers staking out the hotel where Altantuya Shaariibuu was staying with her cousin and friend. Altantuya was last seen alive entering a car driven by Insp. Azilah Hadri on the evening of 19 October 2006.

The fact that DSP Musa Safri, Rosmah Mansor and Najib Razak have managed to avoid being subpoenaed as key witnesses in the Altantuya murder trial incriminates the entire Umno/BN government as accessories to a cover-up of gargantuan proportions.

This is where our rebel prince Raja Petra Kamarudin comes in, both guns blazing, to blow away their cover. He puts his own neck on the chopping block by signing a statutory declaration on 18 June 2008 and publishing it on Malaysia Today for the whole world to read. Raja Petra minces no words in his SD: Rosmah Mansor, wife of deputy prime minister Najib Razak, was present at the crime scene along with others named as Lt. Col. Aziz Buyong and his wife Lt. Col. Norhayati Hasan. Both parties named are attached to Mindef's Engineering Corps and Aziz Buyong is an explosives expert, while Norhayati Hasan is reportedly a personal aide to the defence minister's wife.

What are the police doing about this explosive information? Right now they are busy grilling 25-year-old rapper Wee Meng Chee aka Namewee, producer of Negarakuku, the satirical video more than a million Malaysians have seen on YouTube. Earlier today, they were busy transferring Raja Petra to Kamunting to begin a two-year detention under Section 8(1) of the Internal Security Act.

I APOLOGIZE TO THE CANINE KINGDOM FOR HAVING ASSOCIATED DOGS WITH THE HOME MINISTER AND HIS POLICE FORCE.

Dogs are loyal and serve as watchdogs, we all know. But some dogs are capable of great courage, nobility and intelligence. They are also very lovable and make excellent companions. Such qualities, alas, appear to be completely absent from Syed Hamid Albar and the PDRM. Indeed, judging from their recent behavior, it may be more appropriate to compare them with carrion-eating, cowardly hyenas.

SOMEBODY TAKE THE GARBAGE OUT!

The poor deluded incumbent PM and his pink-lipped deputy just don't get it, do they? We the people cannot take much more of their political hogwash. Their audacious rapacity and their capacity to lie and cheat and steal defy our modest proletarian imaginations.

Umno died in February 1988. The party was pronounced dead (or, at least, illegal) by Justice Harun Hashim after Tengku Razaleigh Hamzah challenged Mahathir Mohamad for the president's post and lost by 43 votes. Razaleigh's camp petitioned for a recount and it was discovered that Umno had broken the law by failing to register dozens of party branches. Twenty years on, the Ketuanan Melayu carcass rotting on our living room floor can no longer be denied nor can it be swept under the rug. Indeed, no rug is big enough to hide it, or thick enough to camouflage the stygian stench of putrefaction.

Their approach to governance is long past its shelf life; their time-serving bureaucratic system is a legacy of 19th century British colonialism which no longer works in the Digital Age where events are measured in nanoseconds; their parochial worldviews are beyond old hat.

You cannot treat the rakyat like delinquent children. We pay your fucking salaries, never forget that!

But these clowns have been cloistered for years in their own little velvet-lined earthly paradise where the Umnoputera elite live and work and plot against one another. So well insulated are they from the realities on the ground that for Abdullah Ahmad Badawi to take a 30-minute ride on the commuter train makes front-page news. How low can anyone go in a futile attempt at damage control, hoping to convince the public that the Umno/BN regime really does care! Prrrrrrrp! Oops, escuse moi (pardon my French).

My dear Badawi & Najib, let me give you the bad news straight (it's kinder this way): the reek of unmitigated evil that permeates the moral fabric of the nation is emanating from you - yes, YOU! That's right. Your style of misgovernance is pure garbage and must be taken out... NOT in a month's time ("after Ramadhan when Parliament reconvenes"), NOT next year (when the global economy goes into a spectacular tailspin), NOT next election (when every honest citizen who dares to speak his or her mind will either have migrated, or will be languishing in an 8 X 8 cell like RPK and all the other heroes detained at the home minister's pleasure in Kamunting)... BUT NEXT WEEK AT THE LATEST!

Malaysiakini (18.09.08): Deputy police chief Ismail Omar today issued a stern warning against those speculating and spreading rumours of a government takeover. He said that these speculations were causing instability in the country, which has been abuzz with talks of a change in government.

Hello, Deputy Chief Ismail! Excuse me, do you have a brain or are you just one of Umno's myriad ventriloquist's dummies in uniform? What's your monthly take-home pay? What??? Is it worth losing your dignity, your integrity, your professional credibility, and your personal reputation for 30 pieces of silver? Come on, brother! Let me spell it out for you in plain language.

The Polis Di Raja Malaysia was inaugurated to serve the rakyat and protect the peace. A change of government is a normal part of the democratic process - otherwise why hold elections every few years? I understand this is the first time we have experienced a radical change of government in Malaysia. That's why we're all so excited, joyful, optimistic, relieved. Regime change is like losing your virginity. It's much easier and not so painful the next time around. So, all you sore losers in Umno/BN have several years to "rebrand" yourself (truth is, you'll have to do a lot more than hire a better PR agency, but this is not the time or place for me to offer you free advice). You can attempt a comeback in GE13 - after Pakatan Rakyat has cleaned up the electoral rolls and refurbished the EC! ;-)

If they're still hogging their seats by 2 October 2008, then you can tell your boys in blue to politely show these Umno diehards the door. If they refuse to leave (pun wholly intended)... arrest them! But please, no handcuffs, too sordid!

Arif drops out of 'bogus' PhD study

Barisan Nasional Permatang Pauh candidate Arif Shah Omar Shah has stopped pursuing his PhD degree after questions were raised over his academic credentials.

“The PhD is not recognised, so I have quit. I am finding a paper that is recognised,” he told Malaysiakini when met at the sidelines of his election campaign on Tuesday.

He was asked to respond to questions raised on the Internet, asking how he could pursue a doctorate degree when he possessed only a diploma and no other intermediating qualification.

An English daily had carried a profile of Arif Shah’s educational background, reporting that he was a diploma holder in civil engineering and currently pursuing a PhD at the ‘Edison University of Technology (off-campus programme).'

The report sparked debate among bloggers who could not verify his academic credentials as they could not find his university name on the Internet.

The 52-year-old Seberang Jaya state assemblyperson clarified the university should be ‘Edision University of Technology’, a university registered in the British Virgin Islands offering distance learning courses.

After checking the Internet and a local industry expert, Malaysiakini found the university has been accused of being a bogus diploma mill.

The local expert, who asked for anonymity, pointed out that the address of the university’s international distance learning centre is shared by hundreds of other companies.

It is believed the address belongs to a company secretary.

GOOD REASONS FOR NOT VOTING ARIF SHAH

MALAYSIAKINI reported that PERMATANG PAUH by election candidate from BN, Arif Shah Omar Shah has stopped pursuing his PhD degree after questions were raised over his academic credentials.

The big question here is if Arif still continued to pursue this bogus Phd. up till April 21, when did he stop then? Did he decide to stop because of the heat coming from Bloggers? First and foremost, how can someone with just a Diploma go on and pursue a Phd. The so-called International Distance Learning Centre of Edision University of Technology is a mailbox office:

If you do a Google search on the above address, you will find hundreds of companies using the same mailbox address.

This clearly proves that it is a Bogus University.

Edision University of Technology is accredited by WORLD ASSOCIATION OF UNIVERSITIES AND COLLEGES (WAUC). The WAUC is global accreditation association founded to establish and promote global standards in higher education among colleges and universities worldwide."

The "accreditor," WAUC, is owned by Dr. Maxine Klein Asher. (Her own degrees are real.) She also owns American World University, which, according to Wikipedia, sells degrees.

You can also find some "ripoff report" articles if you Google her name or WAUC. With just US$1,699 anyone can register a business entity in the British Virgin Islands under the name of university.

Two things bother me about this guy Arif Shah: one, if he knew the PhD from Edision was bogus but yet continued to pursue it, he must be a person of the lowest level of integrity who would be willing to deceive the Rakyat (People) with his phony Phd. If Arif Shah got into the PhD program without checking the University's background (remember, you have to pay a lot of money to get a PhD), then, he must be the biggest oxymoron around. In other words, he is not fit for public office, i.e. State Assemblyman or Member of Parliament.

However, The Scribe has other reasons why Arif Shah should never be voted in as Permatang Pauh MP let alone be the Seberang Jaya Assemblyman for the following reasons:

1. He was the most notable Indian Muslim who claimed himself Malay and participated in the illegal protest at Komtar against YAB Lim Guan Eng and the newly installed Pakatan Rakyat State Government in support of Ketuanan Melayu (Malay Supremacy). A man who forgets his origin just because of his religion, calling himself another can never impress me and any right minded person. The Permatang Pauh Indians need to take note of this.

2. The BN had to scrape the bottom of the barrel to put up Arif Shah as the BN candidate because Arif Shah is the ‘least-hated’ of the five warlords of Umno Permatang Pauh so they hope that with him as the candidate this would reduce the possibility of internal sabotage. Never before had Umno needed to have an Assemblyman to stand for elections as an MP as well.

3. Arif Shah is the brother of Tan Sri Amin Shah Omar Shah who is in now in self-imposed exile in the UK. He shuttles between London and Dubai but would never dare come close to Malaysia because there are criminal breaches of trust (CBT) allegations he may have to answer to. Amin Shah’s company, PSC Industries Berhad, was awarded more than RM24 billion in naval contracts around 1998 at the time Deputy Prime Minister Najib Tun Razak was already the Defence Minister. The government paid him billions in upfront money but Amin Shah’s company never fulfilled its side of the bargain. Billions of Ringgit of Malaysian taxpayers’ money went down the drain in the biggest fraud in Malaysian history. Amin Shah’s brother, Azlan Shah Omar Shah, was the Managing Director of the company.This guy (Arif Shah) is obviously lying when he says that he did not know his university is a bogus one. If he can lie about this, can you believe him when he says that he has no interests in his corrupt brother's business? In other mature democracies, Arif Shah would not even be considered as a candidate.

4. Arif Shah was the Indian Muslim Malay wannabe who made the call as Seberang Jaya state assemblyman to rename George Town “Bandar Datuk Abdullah Fahim”.

5. The BN controlled MSM keeps on spinning that Arif speaks Mandarin and Hokkien and can read and write in Chinese as well. I hope the Permatang Pauh Chinese will remember that this same Arif Shah marched to Komtar with the rest of the Umno racists chanting "Ketuanan Melayu" with the perceived fear that the Chinese have taken over the State. Do you want this racist as your MP? Don't fall for the pictures of Arif Shah reading Chinese newspaper and speaking in Chinese in the local BN controlled MSM.

6. Arif Shah joined the rest of his racist pals from Umno to pressure the Federal Government to scrap all Mega Projects in Penang as punishment to Penangites for voting Pakatan Rakyat. Do we need to add another Umno racist who punishes Penangites to Parliament.
