Letter reveals top MACC man, politician collusion

The mystery letter which emerged at the Teoh Beng Hock inquest yesterday is believed to contain claims connecting a top ranking MACC officer to the interrogation of the political aide, which could have led to his death. Believed to be written by a Malaysian Anti-Corruption Commission insider, the letter alleged how the top officer and an influential politician (pictured left) had worked together to start investigations into alleged corrupt practises by Selangor's Pakatan Rakyat leaders. And it was on this understanding that Teoh was called up for questioning.

The unsigned letter, which carried the MACC official letterhead and written in Bahasa Malaysia, also stated the top officer's modus of interrogation - which involves pulling the suspects by the belt.

It further alleged that the top official was questioning Teoh on the day the DAP man was found dead. However the letter did not state on how Teoh died or if the officer was directly involved in his death.

Further claims made in the letter include:
  • The officer did not punch out from work when he left Plaza Masalam where the Selangor MACC is located on that day. However, the letter stated the time of him leaving the office. This is important as it could show that this officer was the last person to have seen Teoh on that day, alleged the letter.
  • The officer did not provide his DNA samples along with his other colleagues. He only gave a sample privately at a later day.
  • That he ordered his officers to wipe clean the window from where Teoh had apparently fallen from.
  • His alleged corrupt practices while investigating previous cases and that he is generally corrupt.
  • He had helped close an investigation on the politician.
The letter also stated that the top officer had been serving in the state for a long time, well beyond the usual five-year term for high ranking officials.

The letter also claimed that he was living beyond his means by having several houses, a petrol station in Shah Alam and several plots of land, courtesy of the politician's goodwill.
 
He was also allegedly caught for khalwat with his junior officer at the Shah Alam lake early this year.
When contacted, the politician denied all the claims made in the letter and said he will be lodging a police report as soon as he is back from his overseas trip. The MACC officer could not be contacted.

Lawyers remain tight-lipped


Yesterday, lawyer Gobind Singh Deo submitted the letter to coroner Azmil Muntapha Abas, asking him to adjourn the inquest pending an investigation into the contents of the letter.

Gobind said that he was handed the letter by an individual on Tuesday evening.

Azmil, who agreed to instruct the police to probe the letter, had then urged all lawyers involved in the case not to reveal the details of the letter to anyone. However he had not ordered a gag order on the matter.

Lawyers involved in the matter when contacted by Malaysiakini today remained tight-lipped on the content of the letter.

However, it is learnt that the letter was also sent out to several other people since last week, including some members of parliament.

One MP who spoke to Malaysiakini said that he received the letter last week and confirmed the contents of the letter.

"Some big names were mentioned in the letter and the claims are massive. If they are true, some very big people from Selangor MACC and the political circle will have to pay the price," he said, requesting anonymity.

The MP also said that the letter appeared to be "an inside job from MACC".

He added that the letterhead used was from the MACC's headquarters in Putrajaya.

Teoh (left) was found dead, with his belt snapped, at the fifth floor landing of Plaza Masalam on July 16, a day after he was summoned by the MACC for questioning in regards to their probe into an alleged misappropriation of state allocation funds. He was questioned at the 14th floor.

The inquest is being held to determine how he died. It will continue on Monday pending the investigation into the letter.

The letter has also been posted in the Internet at various sites, including in Malaysia Today.

Khir with the help of Hisham and the blessing of the top leadership wanted to topple S’gor PR gov’t. Hisham can’t do it without the approval of the Selangor MACC Head. So Hisham instigated his Boss removal and Ahmad Said sent a weak officer, Jaafar Mahat to head the MACC.

Soon after, the blitz on the PR gov’t by Selangor MACC begins. Hisham was in full control with the approval of Ahmad Said, another corrupt ACA/MACC officer.

FLASHBACK TO AUGUST 2008: UMNO'S HOUSE OF HORRORS (revisited)

SAIFUL BUKHARI BIN AZLAN ON MALAYSIAKINI:

"I swore in the name of Allah at the Federal Territory Mosque this evening in accordance to the teachings of Islam and as advised by religious scholars and teachers that I was sodomised by Anwar Ibrahim."

What is Saiful saying? Islam teaches people to swear in the name of Allah (whose own credibility, credentials, and existence have yet to be established to everybody's satisfaction) whenever accused of any behavior deemed to be an offence? Any boy as pretty as Saiful will have had a long history of being "hit on" by males as well as females. By the age of 23 he ought to have learnt how to accept or refuse such erotic advances. To now claim he was forcibly sodomized by a 61-year-old man with a bad back defies belief - unless he was drugged and raped, which is a whole different scenario. Anyone who has ever attempted penetration of a tight anus will attest that this is virtually impossible without the the acquiescence, consent and wholehearted cooperation of the person to whom the anus belongs.

Penetration by force would result in tissue damage, bleeding and scarring easily detectable by even a cursory rectal examination - and we already have the sworn testimony of the good Burmese doctor at Hospital Pusrawi that no such signs of forced entry were discovered. Apparently a subsequent rectal examination of Saiful Bukhari at Hospital Kuala Lumpur also confirmed that there were no signs of forced entry. Saiful can swear on every book in the world till he's blue in the face - but that won't alter the results of the rectal examinations. Unless, of course, Saiful has an extremely accommodating and elastic anus that allows him to be sodomized by a rogue elephant and still show no physical signs.

Alpha blogger Raja Petra Kamarudin has disclosed on Malaysia Today: "At 2.30pm on Wednesday, 25 June 2008, Senior Assistant Commissioner (SAC) II Mohd Rodwan Mohd Yusof (shown right in a 1998 file picture) met Mohd Saiful Bukhari Azlan in room 619 of the Concorde Hotel in Kuala Lumpur. Prior to this secret meeting, Rodwan and Saiful spoke on the phone at least eight (8) times."

Now this is an extremely detailed disclosure which suggests that somebody within the police force is extremely unhappy with the dirty business at hand and has chosen to be RPK's "Deep Throat." I didn't hear any reporters questioning Saiful at yesterday's press conference about his connection with SAC Rodwan Yusof (who has been accused of helping Musa Hassan falsify evidence against Anwar Ibrahim in the 1998 sodomy allegation instigated by Mahathir). No doubt Saiful would have replied: "I will answer that in court later."

"The oath I've taken was done voluntarily and it was done to uphold the truth as a Muslim, a Malay and a Malaysian."


Saiful Bukhari sees himself as primarily a Muslim, then a Malay, and lastly a Malaysian. I'm sorry, Saiful, but being any of those doesn't add any credence whatsoever to your oath. The Umno chaps all claim to be Muslim, Malay, and Malaysian - and that has never stopped them from lying through every orifice just to cling on to power.

"I understand that if the allegations and oath that I've taken under the name of Allah are not true, I will be cursed by God and tragedy and curse will come upon my family and the generations after me forever."

Even if God lets you off light, Saiful, you can bet your arse you will be spat at and shunned by a lot of people for stooping so low just for a bit of cheap publicity and a "scholarship" from Umno. But please leave your fiancée out of this curse business - I'm sure she had no idea what she was in for. Curse your father (pictured right), if you like; he looks like someone already accursed.

"I've taken this oath to prove that my allegations are completely true. This is the best way for me to attain justice in the world and the hereafter and for me to redeem my pride and dignity as Allah is the only place where I can complain to."

Load of crap, boy! Taking that oath on the Qur'an proves only one thing: you're convinced that other Muslims will be inclined to believe you're telling the truth, and that's what this evil game is really about - to poison the minds of Muslim-Malay voters against Anwar Ibrahim, the greatest threat Umno has ever faced in its entire history. And if you truly feel Allah is your recourse, why did you bother going for a rectal examination at Hospital Pusrawi before lodging a police report on 28 June as instructed by your Umno handlers?

"I've done this for God and I took my oath in the house of God, that I was humiliated and sodomised by Anwar Ibrahim and I do not wish to lie to the world as he has done."

You twisted little shit, Saiful! Umno is NOT God! You've been offered filthy lucre to "sacrifice yourself" to save Umno from Anwar Ibrahim - and you saw a golden opportunity to attain global notoriety as Anwar's political assassin - exactly like Mark David Chapman believed he would forever be remembered as the fuckwit who shot John Lennon.

Saiful, an omniscient, omnipotent, and omnipresent God would already know what a "good" boy you are (no need for you to
 sumpah on the Qur'an, that's only for show); an all-powerful God would have intervened to protect your chastity from being ravaged. God the omnipresent also resides in your anus and, for all we know, probably relishes the occasional rectal probe!

Saiful to answer charges of "qazaf" (reprise)

At 11AM today (27 November 2008) Saiful Bukhari Azlan, who lodged a police report 28 June 2008 that he had been anally raped by Anwar Ibrahim, presented himself at the Federal Territory Islamic Religious Department (JAWI) for further questioning with regard to Anwar's formal complaint on 9 July 2008 that Saiful Bukhari had committed qazaf (wrongfully accusing a chaste man or woman of adultery or homosexuality without four reliable witnesses).

The punishment for those who accuse others of committing adultery and sodomy without substantiation is, according to various Islamic scholars, similar to those who commit such offences.


HERE'S A POINT-BY-POINT SUMMARY OF SALIENT FACTS SURROUNDING THIS PERPLEXING AND SORDID AFFAIR THAT HAS MADE MALAYSIA THE BUTT OF ENDLESS ANUS JOKES:


1. Saiful Bukhari Azlan is reportedly Mumtaz Jaafar's "Godson."

2. Mumtaz Jaafar is reportedly Rosmah Mansor's business associate and "bag lady."

3. Najib Razak finally admitted (under pressure) that Saiful Bukhari had visited him and his wife at their residence "a few days" before Saiful lodged his infamous police report against Anwar Ibrahim. Najib had earlier stated that Saiful only visited his office and discussed getting a "scholarship" with Khairil Anas Yusof, "special aide" to DPM Najib. Initially, Najib insisted he had "never met" Saiful personally. Then MT published part of a video interview with a friend of Saiful Bukhari who attested he had accompanied Saiful on his visit to Najib & Rosmah's residence...

4. Malaysia Today also published a story stating that Saiful Bukhari had met Senior Assistant Commissioner (II) Mohd Rodwan Mohd Yusof in Room 619 of the Concorde Hotel at 2:30 PM on 25 June 2008 (3 days before the police report was lodged). The MT report also alleged that Saiful had been in phone contact with Rodwan Mohd Yusof and other police officers for several days prior to that rendezvous at the Concorde. Rodwan Mohd Yusof happens to be IGP Musa Hassan's "dirty tricks" agent and was involved in Anwar's 1998 sodomy trial (he demanded Anwar's DNA sample from the Hospital Besar KL which was later used on the infamous Tivoli mattress). To date there has been no official denial or investigation of these allegations. Rodwan Mohd Yusof had "no comment" when questioned by reporters.

5. Saiful Bukhari Azlan's biological father, Azlan Mohd Lazim, had abandoned Saiful's mother when Saiful was still a toddler. Recently, Azlan Mohd Lazim (seated beside Saiful, above) reappeared in Saiful's life when he accompanied his estranged son to the swearing ritual at the Federal Territory Mosque officiated by a newly appointed imam, Ramlang Porigi, on 15 July 2008 (one day before Nomination Day for the Permatang Pauh by-election). Azlan Mohd Lazim was also present at a press conference afterwards. It was subsequently revealed by MT that Azlan Mohd Lazim earns his living mainly as an Umno go-between, fixing deals and negotiating clandestine transactions, and was instrumental in coordinating the secret PAS-Umno meetings soon after 8 March 2008. Azlan Mohd Lazim is on a special committee of Umno entrepreneurs, headed by Romeli Musa (of Sapura Holdings) determined to stop Anwar Ibrahim from becoming PM and Pakatan Rakyat from taking over the federal government.

6. During the Permatang Pauh by-election campaign, looped video footage of Saiful Bukhari swearing on the Koran that Anwar Ibrahim had forcibly sodomized him was repeatedly and almost continuously projected on giant outdoor screens at all BN operations centers. However, Ramlang Porigi, the imam who had officiated at Saiful's swearing ritual, showed up at PKR ceramahs & publicly stated that he was unwittingly and unwillingly dragged into the whole affair - in fact, Ramlang revealed that Khairil Anas Yusof ("special aide" to the DPM) had arranged the swearing ritual and that Ramlang himself had no say in the matter. He was bombarded with angry messages from friends and strangers afterwards and realized he had to come out in the open & officially disassociate himself from Saiful's swearing ritual.

7. Saiful Bukhari showed up at Hospital Pusrawi after lunch on 28 June 2008 complaining of acute pain in his own arse ("someone shoved some plastic object up my rectum..."). He was rectally examined by Dr Mohamed Osman Abdul Hamid who found no signs that Saiful Bukhari had been forcibly sodomized and said as much in his medical report. Subsequently, the Hospital Pusrawi report was leaked to the media (it first appeared in Malaysia Today, of course), and that made the entire case go limp. On 7 August 2008 Anwar Ibrahim was charged with "consensual" sodomy under Section 377B of the Penal Code, contradicting Saiful Bukhari's insistence under Koranic oath that he had not consented and was, in fact, raped by Anwar (believe it or not, Ripley!)

8. Dr Mohamed Osman Abdul Hamid subsequently read a statement at a press conference endorsing the authenticity of the leaked Hospital Pusrawi medical report and maintaining that he stood by the results of his rectal examination. Dr Osman also revealed that he had been repeatedly visited by police officers who made him sign statements in Malay which he did not fully understand (being a Burmese national) & which contained extraneous details added by the police.

As far as I'm concerned this case is closed, QED.

For Saiful Bukhari's protection (from possible attack by morally inflamed Anwaristas and ardent connoisseurs of plump young rumps) I recommend that the good Burmese doctor be assigned to bung up Saiful's pert little ass. However, if Dr Osman has already left the country - and who can blame him, after all the stress he's been subject to? - then we'll just have to hand Saiful over to that Honorable MP from Kenabatangan, Bung Mokhtar Radin (who's reputed to be quite an expert on bunging up leaky holes).

Kenny Gan (Letters to Malaysiakini): When Anwar’s trial begins, Saiful should be asked one question: ‘Does he agree to the charge under Section 377B of consensual sodomy?’ If he still insists as per his public stance that the act was non-consensual, the charge should be amended to Section 377C covering non-consensual sodomy or be thrown out.

This is more than a technical definition. Section 377C involves an element of force which must be proven and hence it is much more difficult to obtain a conviction given the facts of the case. There are no two ways about it. The prosecution cannot give themselves an easier job to convict Anwar for consensual sodomy while the witness denies it. For Anwar’s case to proceed under the present charge, Saiful must be willing to repudiate his public stance of forced sodomy and take the adverse repercussions given his swearing on the Quran. Otherwise, it must be amended to Section 377C. Anything else is a gross miscarriage of justice.

WE CAN ALL BE HEROES (ONCE MORE, WITH FEELING!)

"Mati ayam, mati tungaunya (if the fowl dies, its ticks perish too)" - an old Malay saying.

As far as I’m concerned, Umno-BN is deceased. Finito. R.I.P. Kaput. What happened on March 8th was a gigantic Samurai sword that moved so swiftly the 10-headed hydra of Might-Is-Right that has terrorized us for the last 25 years lost all its heads. The BN survivors of the March 8th debacle are all operating in Safe Mode now, their operating systems having crashed big-time. Perhaps the Umno-BN hard drive can still be booted up a few more times and some useful data saved - but the motherboard itself is on the verge of terminal malfunction. So let's not speak ill of the dead.

Anyone who hasn’t been brainwashed by establishment pundits with vested interests can see that Anwar Ibrahim has got what it takes to steer this floundering ship back on course. And what it takes is intelligence, courage, stamina, adaptability, good humor, experience, and most importantly, ethical sense. His resilience has been proven over the last ten years by his capacity to transmute tragedy into triumph, transforming himself from victim to victor - all the while maintaining his dignity, clarity, and focus.

Whatever his early political agenda, the Anwar Ibrahim of 2008 has been forged in the furnace of personal pain and endurance. In 1998 he could have taken the money and run - become an academic or corporate CEO. But he didn’t. He stood up to Mahathir (right) and fought like a man. That’s how he gained my respect and admiration and trust. There are very few in our midst today that I can describe as “heroic.”

Is Chandra Muzaffar a hero? He might have been once, back in the early 1980s when he left academia to battle the monstrous menace of Mahathir. But after his ISA experience in 1987, Chandra’s spirit buckled. He left Aliran to establish JUST and for a few years he continued to say the right things. But he had lost his fire, his fighting spirit. He had gone the way of Lee Lam Thye.

Is Raja Petra Kamarudin (left) a hero? Most certainly. He stood by Anwar Ibrahim in the early days of his rebellion against monumental odds and was arrested under the ISA for his efforts. He was a tireless webmaster for the official Reformasi website and that subsequently led to his launching Malaysia Today - a "no holds barred" local news portal that has played a crucial role in exposing the dark side of Umno-BN and gained an immense readership. Indeed, RPK grew to be such a thorn in BN's backside a police report was filed against him by an Umno hatchetman and he was interrogated for eight hours. He threw his energy into the Opposition campaign as a featured speaker at many ceramahs (political rallies). Although a bona fide prince, RPK has always been accessible, down-to-earth and his finger is firmly on the pulse of the people. A large part of the credit for what happened on March 8th must go to RPK.

[Since this essay was written, much has transpired that warrants the inclusion of a footnote: RPK was arrested under the ISA in September 2008 and sent to Kamunting; in November a courageous high court judge ordered his unconditional release, and RPK subsequently went into self-imposed exile; recently, RPK turned petulant and began attacking Anwar Ibrahim, although it appears to be more a personal than political feud. This has dimmed RPK's heroic lustre to a large extent, even if he remains a positive force for change.]

Is Tian Chua a hero? I would say YES! His career as a politician is only just taking off and he has learnt fast, especially after nearly losing his parliamentary seat over the ridiculous charge of biting a policeman. In any case, his fearlessness in the face of police violence has inspired many to speak up or march for justice. There are many other heroes I can think of: Lim Guan Eng, the new Chief Minister of Penang, for example, jailed by Mahathir for speaking up on behalf of a schoolgirl gang-banged by the former Chief Minister of Melaka; Tony Pua, who sold his successful IT business to launch his political career as an outspoken blogger and DAP candidate; Sivarasa Rasiah, who has spent the last 20 years defending human rights... it so happens they are all in the Pakatan Rakyat.

And then there's Steven Gan, managing editor of Malaysiakini, who stuck to his guns as a political journalist and quit The Sun when he rubbed the establishment up the wrong way. In 1999, at the height of Reformasi fervor, Steven teamed up with Premesh Chandran to launch Malaysia's first news portal. Over the years Malaysiakini has survived several police raids and the confiscation of its computers. For invaluable services rendered to truth-loving Malaysians, this news portal deserves a standing ovation - and a thousand-fold increase in subscribers!

But to my mind nobody can match what Anwar Ibrahim has accomplished: he has led us through the Chapel Perilous of racial politics and now, for the first time since Merdeka, we can look around and appreciate the beauty of our own diversity and say, “Vive la difference!” On March 9th I was blissed out by a tangible feeling that we are no longer stuck in the rut of ethnocentric tempurungism, that we have finally outgrown all that “Bangsa-Ugama-Tanahair” hot air. I went to town and felt the genuine goodwill and jubilation that shone from every face I saw - Malay, Chinese, Indian, Orang Asli, Dan-lain-lain!

What has been missing all these decades is the possibility that we can love one another as humans, regardless of skin color or creed - that’s because cold-blooded ambition and ruthless greed have no use for empathy and warm feelings, nor does it encourage compassion, kindness, and spontaneous joy. No, it feeds and fattens itself vampire-like on fear - other people’s fear. And now, on that bright Sunday morning after GE12, the fear had dissipated like a bad smell in the winds of change. PKR flags fluttered proudly against a glorious blue Selangor sky, proclaiming that the people's eyes were open at long last.

In the climate of fear Mahathir created during his 22-year reign, anybody who dared speak the truth became a hero - or martyr. Anwar Ibrahim, more than any other political icon in the country, succeeded in transcending his own childhood prejudices to embody the universal values that will unite rather than divide us as a nation. That is indeed the mark of a hero. Let us honor this hero (who nearly became a martyr) by giving him what he fully deserves - the chance to serve as prime minister (at least till he tires of it or we tire of him). At the same time, let us all aspire to become heroes too, so that we will no longer be scared children in need of a grown-up to lead us across the street. Let us each become, in time, self-governing individuals whose relationship to our political leaders is akin to an orchestra’s respect for the conductor, knowing full well that his job is to create a symphony from the potential cacophony of so many different instruments.

Why are you dragging your feet, MACC?

MACC STUMPED AND DOES NOT KNOW WHAT TO DO

On 3 December 2009, Shamsul Iskandar Mohd Akin, the Parti Keadilan Rakyat Youth Leader, lodged a report at the MACC headquarters in Putrajaya asking them to investigate private investigator P. Balasubramaniam’s latest revelation implicating Prime Minister Najib Tun Razak’s family in covering up the murder of Mongolian national Altantuya Shaariibuu. In response to this report, the MACC asked Shamsul to help locate Bala and to make him available for questioning.

On 4 December 2009, Bala’s lawyer, Americk Sidhu, sent Abdul Rahman Bachok, the investigating officer from the MACC, an e-mail informing him that he is prepared to assist the MACC in securing Bala's attendance at any interview the MACC would like to have with him, but under certain conditions.

On 8 December 2009, lawyer Americk received a phone call from Abdul Rahman Bachok on his mobile phone enquiring whether it was really him who sent that e-mail on 4 December 2009. Americk confirmed that he did and reiterated the contents of the e-mail and suggested that Abdul Rahman respond to it immediately.

However, there was no response from Abdul Rahman, so on 10 December 2009 Americk sent him another email confirming their telephone conversation of 8 December 2009 plus reiterating what he had said in his first e-mail and, again, requested an immediate response.

Until today there is still no response from Abdul Rahman or the MACC and it appears like they are stumped and do not know what to do. To respond would mean that the MACC would have to meet Bala and take his statement, which is clearly something they would not like to do.

The MACC was hoping that Shamsul would not be able to contact Bala and this would mean they could conveniently close the file and declare that they can’t proceed any further since Bala can’t be contacted. But now, since Bala’s lawyer Americk has already communicated with them and has offered to arrange a meeting so that they can take Bala’s statement, they are not able to close the file and stamp it NFA (no further action).

But what do they do? They can’t close the file on the excuse that Bala can’t be contacted since his lawyer has already got in touch with the MACC. Yet they do not dare meet Bala to take his statement as this will not augur well for the Prime Minister. So now they are running around like headless chickens and are praying hard that the matter will die a natural death and Malaysians will soon enough forget about the whole matter.

But the matter will not go away. The MACC has no choice but to respond to Americk’s e-mails. It is just that they are still deciding on how to respond without hurting the future of Prime Minister Najib Tun Razak.

Damned if you do, damned if you don’t - either way the MACC is damned. And this would mean the damnation of their boss the Prime Minister as well.

Ooo, I just love the way this is turning out.

1. That the interview be conducted in either Singapore or London.

This curt reply to crassly cut reporters off from asking further questions sounds to me more like a reflex in panic, rather than a responsible answer from the prime minister of a supposedly democratic country. For it was a totally inappropriate reply to Bala’s serious accusation, made in circumstances that commanded respect and credibility.

What can be more serious than accusing Najib’s wife Rosmah Mansor and his brother Nazim of having used the “carrot and stick” maneuver to force Bala to retract his first affidavit which implicated Najib in the murder scandal?

And what can be more respectable than having his revelations made in an interview conducted and witnessed by three senior lawyers of the country?

Bala alleged that Rosmah’s close associate, Deepak Jaikishan, offered him RM5 million; and Nazim Razak threatened to harm his family unless he followed Deepak’s instructions. This happened on the day he disclosed his first affidavit on 4th July 2008. Fearing for the safety of his family, Bala retracted under coercion the allegations linking Najib to Altantuya in a second affidavit the next day, and disappeared immediately with his family - until his recent interview which was captured on video and recorded in transcripts. These were first published in Malaysia Today and later relayed by other websites including Malaysiakini and YouTube.

In the interview, Bala described how he was forced into retraction, and how he and his family embarked on their fugitive journey to India under the overall direction of Deepak. That journey was a rather convoluted and lengthy voyage that saw them passing through or staying for various durations in Singapore, Bangkok, Kathmandu, Delhi, Madras, and eventually Chennai.

Bala exuded confidence with his detailed description of occurrences supported by factual details that pinpoint the relevant players, locations, times, dates, durations, hotels, monetary figures, cheques, bank accounts, etc.

Against these formidable allegations, all we have from the alleged culprits is deafening silence, despite the news being circulated in the Internet for more than two weeks. Until, of course, when Najib dismissed these as “frivolous” and not worthy of his response, during a press conference after an UMNO supreme council meeting on December 4th. This effectively means that Bala has cooked up a pack of damned lies, according to Najib.

So, one of them must have lied. Was it Bala, or was it Najib?

FACTS FAVOR BALA

A cursory glance at the facts and circumstances surrounding the latest controversy would enable one to readily conclude that Bala has the upper hand, for the simple reason that Bala’s accusation is buttressed by precise facts and details that can be easily debunked if false, while Najib and his group have chosen to remain silent in spite of the serious nature of the accusation.

If Bala’s statement is false - and with the immense power and resources at the disposal of the Prime Minister - there is no possible reason for Najib not to have instantly ordered an investigation, and bring Bala to face the consequences for having so openly and repeatedly defamed the Prime Minister and his family.

If Najib could have Raja Petra Kamarudin - webmaster of Malaysia Today - charged with criminal defamation for the publication of an article in his website that said Rosmah was present at the crime scene, why can’t he do the same with Bala?

In fact, Bala’s case is even more serious, as he has signed two contradictory affidavits – a clear offence of false declaration – besides accusing the Prime Minister and his family of involvement in murder.

And why should the Prime Minister, his family, and the various law-enforcement agencies be so kind and forgiving to Bala as to leave him untouched, while the nation suffers the humiliation of its Prime Minister being openly defamed and ridiculed?

FROM ANOTHER PERSPECTIVE

Viewing the case from another angle – Bala’s perspective, it appears even more compelling that Bala was not likely to have lied.

Why should a family man like Bala falsely accuse the Prime Minister of involvement in the most heinous of crimes, knowing its serious consequences as an ex-police officer? What possible gain could he get, keeping in mind that he couldn’t have extorted any money, since the allegation is untrue?

Even if it is true that Bala had falsely accused Najib, that he had repented and retracted his allegations in a second affidavit, and run away to another country to escape retribution, there is no conceivable reason for him to make a come-back to invent another pack of lies, thereby exposing himself for the second time to the risk of serious punishment. Unless, of course, he is a lunatic, which is clearly not the case.


GROUNDS OF SUSPICION ABOUND


Evidence of justice being aborted to protect Najib is found in the numerous irregularities that have occurred before and during the trial of the Altantuya murder.

Why was Najib not investigated since the first two accused, who were his bodyguards and took orders from him, had no apparent motive on their own to commit the murder, and the third accused was his confidant?

Why were the judge, prosecutors and even a defence lawyer abruptly replaced without credible reasons shortly before the trial?

Why was the motive for murder never raised during the trial?

Why did prosecutors and defence lawyer join forces to prevent critical evidence being pursued in court such as a certain photograph showing Altantuya and Najib taking meals together and the mysterious erasure of immigration entry records of Altantuya and her Mongolian companions?

Why was Bala’s affidavit barred from the court without credible reasons?

Since the third accused, who was charged for instigating the murder, was released without his defence being called, then who had ordered the killing?


It is clear that unless these troubling questions are dealt with satisfactorily, there is no way Najib can clear himself of suspicions that have surrounded him, least of all by waving away inquisitive questions by a curt reply like what he did in the said press conference.

In fact, such conduct only betrays his weaknesses. For it is plain commonsense that if Najib is on the side of truth, he would have welcomed reporters to ask questions – instead of crudely shutting them up – so that he has a chance to exonerate himself. And he would also have taken action against Bala ages ago, instead of inaction for so long – perhaps with the hope of the scandal fizzling out in due course?

The latest Bala revelations have constituted a solemn challenge to the integrity and legitimacy of Najib’s premiership, for which he must now solemnly account to the nation.

And the only way to do that without dishonoring his oath of office is to commission a truly independent panel to uncover the truth and account to the nation.

If Najib is a responsible Prime Minister, he should have felt duty bound under his oath of allegiance to the country to clear his name through a proper inquiry by an independent and reputable panel, now that the perception of his involvement has been so entrenched and pervasive - nationally as well as internationally.

One more reason why Malaysia Today is under severe attack!

Since Malaysia Today published leaked cabinet memos on 17 September revealing that the finance ministry had sought the BN government's approval and endorsement of the RM12.5 billion Port Klang Free Zone scam, knowing full well it was exposing future generations of Malaysians to colossal debt, the popular news portal founded by RPK has been under massive attack by paid hackers. On Sunday, 27 September, RPK released yet another explosive document that only served to provoke intensified attacks against MT. I managed to save the text and one image from MT before the site became inaccesssible. The least I can do in the face of such dirty tactics is to reproduce RPK's post for those who have yet to read it...

Another case under the OSA for the IGP to NFA

Two army officers were in the home of the then Deputy Prime Minister for about eight hours during the time Altantuya was supposed to have been murdered. Why they were there during those eight hours and who these two army officers are has not been revealed...

The Malaysian government says Altantuya Shaariibuu was murdered between 10.00pm on October 19th and 1.00am on October 20th, 2006. That was the charge against Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar and that was what they were pronounced guilty of.

At 10.01pm on 19th October 2006, two unnamed army officers went to Najib Tun Razak’s house, according to log entry 6494 in the police guard book. (see scanned images of log 1a and log 2a below). These same two unnamed army officers left Najib’s house at 6.05am on 20th October 2006, according to log entry 6498 (see images of log 1b and log 2b below).

The purpose of the visit was never clarified.

This means these two army officers were in the home of the then Deputy Prime Minister for about eight hours during the time Altantuya was supposed to have been murdered. Why they were there during those eight hours and who these two army officers are has not been revealed.

From 10.01pm the night Altantuya was murdered until 6.05am the following morning, two army officers visited the Deputy Prime Minister and/or his wife. This is certainly a most odd time to visit a Deputy Prime Minister and/or his wife in their home. And what does one do for eight hours in someone’s home during the time most people would be fast sleep?

According to Fauzi, a driver, Rosmah Mansor left the official residence of the Deputy Prime Minister in Putrajaya at 6.48am on 19th October 2006 using car registration number WLQ 11 to return to her private home in Taman Duta. The car odometer reading was 86,197. That same evening, Rosmah attended a function near the Tabung Haji building in Jalan Tun Razak in Kuala Lumpur

She did not return home until 11.20pm later that night, according to Fauzi.

The next day, 20th October 2006, Rosmah left her official residence in Putrajaya at 6.32am using the same car bearing registration number WLQ 11 to, again, return to Taman Duta. She also ran a few errands and did not return to Putrajaya until 1.01am the following morning.

The odometer reading was 86,315.

On the third day, Rosmah repeated the itinerary. She left Putrajaya at 6.40am to return to her Taman Duta home and to run some errands and did not go back to Putrajaya until 9.34pm that night. The odometer reading was 86,550.

Over three days, Rosmah travelled more than 350 kilometres to shuttle from Putrajajaya to Taman Duta, plus to some other places in between, according to the records.

I suggest the IGP investigate how these 'officials secrets' managed to leak out and whether the Official Secrets Act (OSA) has been breached. Or maybe the IGP would rather bury the whole issue and file it under No Further Action (NFA) to save the Prime Minister and his wife from having to answer some very embarrassing questions.

Hmm... I wonder who these two unnamed army officers are and whether they were really at the Deputy Prime Minister's house those entire eight hours or whether they sneaked out and in again without any 'official record'.

Ooh, I just love the OSA that protects the wrongdoer and instead sends the whistleblower to jail.

KUALA LUMPUR, Sept 10 — After absconding from his sedition and criminal defamation trials, fugitive blogger Raja Petra Kamarudin appears to have begun his own defence through the first in a series of video interviews of him on the Internet.

Hosted on Youtube, RPK, as he is popularly known, renewed his attacks against the police and the Attorney-General for deciding to prosecute him over allegations he made regarding the prime minister and his wife’s involvement in the murder of Altantuya Shaariibuu.

He also compared his case to the vigour shown in the investigation of alleged corruption by the Selangor Pakatan Rakyat (PR) government.

“The government raids the offices of a Selangor exco based just on Internet reports. Somebody publishes a story accusing an exco member of taking money and they raid the office.

“The source of the information and the allegation is anonymous but it is enough for government to spring into action,” he said in the short video clip of just over six minutes.

Speaking about his own troubles with the government, he pointed out that he did not make an anonymous declaration about the Altantuya murder, but signed a statutory declaration.

He claims the information was given to him by a senior officer in the Military Intelligence.

In the video RPK repeats the allegations, which has been denied by government officials, that military personnel with links to Datuk Seri Najib Razak and his wife Datin Seri Rosmah Mansor, were present when Altantuya was killed.

Deputy Prime Minister Najib Abdul Razak today denied allegations that he had links with murdered Mongolian Altantuya Shaariibuu as claimed by a private detective.

Reading out from a prepared statement at a packed press conference in Parliament this evening, the embattled deputy premier reiterated that he had never met or knew Altantuya.

He dismissed the statutory declaration filed by private eye P Balasubramaniam, who was hired by Najib's close associate Abdul Razak Baginda to deal with the Altantuya problem, as "concocted" claims.

Private investigator P Balasubramaniam made shocking claims on 3 July 2008 that Deputy Prime Minister Najib Abdul Razak had links with murdered Mongolian Altantuya Shaariibuu. The next day, after meeting a police inspector at the Brickfields Police Station, Balasubramaniam held another press conference at a hotel, accompanied by a new lawyer, and retracted all parts of his original statement referring to Najib. A day later Balasubramaniam and his family disappeared and they have not been heard from since.
